Delhi High Court has issued directions to the Forensic Science Laboratory to quickly conduct a DNA test of a charred body which is stated to be associated with the riots that broke out in northeast districts of Delhi. The Bench comprising of Single judge Justice Vibhu Bakhru has directed the laboratory to conduct the test and to convey the results as soon as possible, and before 18th April 2020.
The plea was moved by Gulshan, and she sought directions to be issued to the respondents to conduct a DNA test on the charred body as soon as possible.
Further, it was contended by the petitioner that her father was a victim of the violence that started in North East Delhi on 23rd February 2020, it was further pleaded before the court that her father was shot and burnt, though she has identified the body, to get the confirmation DNA matching must be done as the body is charred. It was brought to the notice of the court by the counsel appearing for the Delhi government, Mr Naushad Ahmed,“…priority is accorded to the victims of the recent violence, and the DNA matching of the body identified by the petitioner would be done by 16.04.2020 as the same is already underway.”Justice Navin Chawla noted the submission of the counsel for Delhi government that there is a delay in testing only for want of orders from the court and said, “As there is no such provision of law shown requiring orders from the court, such delay cannot be countenanced”.
