The Bombay HC on 8th April 2020 directed the Municipal Corporation of Greater Mumbai (MCGM) and Brihanmumbai Electricity Supply and Transport to restore the electricity and water supply to a building in Central Mumbai located in Andheri East which is dilapidated, as there are families still living in it. (Shahid Bhagat Singh Cooperative Housing Society v/s The State of Maharashtra & Ors)
The petitioner Shahid Bhagat Singh Cooperative Housing Society was represented by advocate Anand Jondhale stated in their petition that there are 23 families living in the building without electricity and water and are unable to shift from the dilapidated building because of the lockdown, also their area is sealed due to few positive COVID-19 cases found in the place.
The petitioner relied on the order passed on 26th March 2020 by a unique bench of HC restraining the civic bodies from carrying out demolition and eviction during the lockdown period to avoid unnecessary chaos. The petitioner also assured that the residents would vacate the premises within four days once the lockdown is lifted.
Justice A.A. Sayed heard the petition through video conferencing and he directed the respondents, MCGM and BEST represented by advocate Rajesh Patil, to restore the electricity and water supply to the housing society immediately upon the petitioner paying the necessary changes. The court also mentioned that the families will not be given an extended time for shifting once the lockdown is lifted.
