Nirbhaya: Fresh death warrant issued to all four convicts- to be hanged on Feb 1
NEW DELHI: After the President Ram Nath Kovind rejected the mercy petition of Mukesh, one of the four convicts in case of Nirbhaya gangrape- murder 2012, fresh death warrants got issued on Friday by Delhi court against culprits, and a new date was set for their hanging, i.e. Feb 1, 2020, at 6 am. Additional Sessions Judge Satish Kumar Arora of Patiala House Court, Delhi heard the plea of Mukesh Singh who asked for the postponement of his execution from Jan 22.

The convicts Mukesh, Vinay Sharma, Akshay Kumar Singh, and Pawan Gupta were to be hanged, but the execution got delayed when Mukesh filed a mercy petition. However, it got rejected, it effected as delayed execution. Also, Akshay, Pawan and Vinay haven’t filed mercy petition yet, and Akshay and Pawan haven’t moved their curative petition as of now.

As per Delhi Prison Manual, all the convicts against whom the same death warrant is issued, shall be executed together and also there should be 14 days between the day of rejection of petition and the day of execution.

Asha Devi, Nirbhaya’s mother, said that “The convicts are getting what they wanted” expressing displeasure with the delay in the hanging.

The court also instructed the authorities of Tihar Jail to submit a report regarding steps taken by them under Rule 840, read along with Rule 863, of Delhi Prison Rules, 2018 which was directed only after the authorities of jail informed the court that they had submitted an application about scheduled execution to Delhi government.

The delay in hanging also triggered the blame game between BJP and AAP. The Union Minister Smriti Irani stated that it was because of the AAP government, the convicts couldn’t be hanged in time. To which AAP supremo said that “I feel sad that politics is being done on such an issue.”
